45 daysThe Application and Notice of Lien must be filed not later than 45 days after the "date of completion" of the improvement (HRS § 507-43(b)). Hawaii's mechanic's lien is a court-application process. Rather than recording a lien directly, you MUST apply to the circuit court of the circuit where the property is situated by filing an "Application For A Lien" accompanied by a written "Notice Of Lien" setting forth the facts on which the claim is based. Copies must be served (like a summons) on the owner, any party with an interest, and the party who contracted for the improvements. The Application and Notice are returnable not less than 3 nor more than 10 days after service, and the court holds a hearing to determine whether probable cause exists for the lien to attach. The lien does not attach until the court so orders. The "date of completion" is the time the owner or general contractor completes publication of a notice that the improvement has been completed or abandoned and files an affidavit of publication with the circuit court clerk. If no valid notice of completion is published and filed within one year after actual completion or abandonment, the "date of completion" is deemed to be one year after actual completion or abandonment. Hawaii is NOT an unpaid-balance state.
Enforcement
3 monthsThe lien expires 3 months after entry of the Order Directing Lien To Attach unless proceedings are commenced within that time to collect the amount due by enforcing (foreclosing) the lien (HRS § 507-43(e)). After demand and refusal or neglect to pay, the lien is enforced by an action filed in the circuit court of the circuit where the property is situated (HRS § 507-47).

Preliminary Notice & Notice of Intent
Preliminary Notice: Not required Notice of Intent to Lien: Not required. Hawaii does not use a preliminary notice or a notice of intent to lien. Instead, the lien is obtained through a court process: the claimant files an "Application For A Lien" and a written "Notice Of Lien" in the circuit court where the property is situated, and the court holds a probable-cause hearing before the lien attaches.
Who Can File a Mechanic's Lien
Any person or association of persons furnishing labor or material in the improvement of real property is entitled to a lien (HRS § 507-42). Hawaii courts read this broadly to include general contractors, subcontractors, suppliers/materialmen (including materialmen of subcontractors), and design professionals such as architects and engineers whose plans or supervisory services are incorporated into the improvement.
Who Gets the Notice
Copies of the Application and Notice must be served, in the manner prescribed for service of a summons, on the owner of the property, any person with an interest in the property, and the party or parties who contracted for the improvements if other than the owner. If a person entitled to notice cannot be served, notice may be given by posting on the improvement.
Information Required
Information needed for the Application and Notice of Lien in Hawaii includes: - The amount of the claim - The labor or material furnished - A description of the property sufficient to identify it - The names of the parties who contracted for the improvement - The name of the general contractor - The names of the owners of the property and any person with an interest therein - If the claim has been assigned, the name of the assignor - Any other matter necessary to a clear understanding of the claim
Hawaii Public Works
In Hawaii, a mechanic's lien on public works projects is not available; a lien cannot attach to property owned by the government (see Att. Gen. Op. 72-13 under HRS § 507-42). Subcontractors and suppliers on public projects instead make a claim against the prime contractor's payment bond under Hawaii's Little Miller Act (HRS Chapter 103D, the procurement code). To preserve a bond claim, a claimant who has no direct contract with the prime contractor generally must give written notice to the contractor within 90 days after the last day it furnished labor or materials. A suit to enforce a payment bond claim must generally be brought within 1 year. Because bond deadlines and requirements are procurement-specific, confirm the exact dates for your project.
