Indiana Lien Deadlines

Preliminary Notice

30-60 days

If new construction on a residential owner-occupied project (1-2 dwellings), the deadline to record and serve a "Notice of Intention to Hold a Lien" (official name for the pre-lien) is within 60 days of starting work. If performing alterations or repairs on an existing residential owner-occupied project (1-2 dwellings), the deadline to mail the "Notice of Intent to Hold a Lien" is within 30 days of starting work, but this is not required to be recorded. Not required for commercial projects .

Mechanic's lien

60-90 days

On residential projects (1-2 dwellings), a "Sworn Statement and Notice of Intention to Hold Mechanic's Lien" (official name of the lien) must be recorded within 60 days of last work (for both new homes and remodeling jobs). On commercial projects, a "Sworn Statement and Notice of Intention to Hold Mechanic's Lien" must be filed within 90 days of last work. Enforcement must be initiated within 1 year from the date the "Sworn Statement and Notice of Intention to Hold Mechanic's Lien" was recorded. However, the project owner can shorten this deadline to 30 days by sending the lien claimant a notice to foreclose the lien. Mechanic's liens cannot be extended in Indiana.

Contractors, subcontractors, suppliers, architects, land surveyors, and engineers are entitled to mechanic's lien rights in Indiana. Suppliers to suppliers also have rights.

Indiana Public Works

In Indiana, a mechanic's lien on public works projects is not available. Public works projects in Indiana over $100,000 are required to have a payment bond. File your notice of bond claim within 60 days of your last day on the job, and file suit within 30 days of your notice of bond claim for public jobs that are not Indiana Department of Transportation (INDOT) jobs. For INDOT jobs, a statement of the amount due must be "furnished" to the surety within one year after the acceptance of the work.
