Kansas Lien Deadlines
Preliminary Notice
Based on project typeResidential new build projects require that a Notice of Intent to Perform (preliminary notice) be recorded at the county and served on the owner. The deadline is prior to the recording of the deed of the new owner. A Notice of Intent to Perform is good for 18 months, but needs to be amended if the project lasts longer. When the job is complete and the contractor is paid, this notice must be released and a lien waiver must be provided to the owner.
Intent to Lien
Based on project type (required prior to lien)A "Warning Statement" is required to be served prior to the lien recording and only on existing residential projects (1-2 dwellings). It is not required on new construction residential or commercial jobs.
Mechanic's lien
90 daysMust be filed within 90 days of last work. Enforcement must be initiated within 1 year of lien filing. Mechanic's liens cannot be extended in Kansas.

Suit on a payment bond must be brought within 6 months of project completion (1 year for suit on a highway bond).
