Nevada Lien Deadlines

Preliminary Notice

31 days

Notice of Right to Lien must be given within 31 days of starting work.

Notice of Intent to Lien

15 days prior to lien

(AKA 15-Day Notice) Must be served 15 days before the lien on owner-occupied residential projects only. The 15-Day Notice will extend the time for recording the notice of lien by 15 days.

Mechanic's lien

90 days

Must be filed within 90 days of last furnishing labor or materials. However, if the project owner files a Notice of Completion (or Cessation) with the county recorder, the deadline is reduced to 40 days from the date the owner files. Enforcement must be initiated between 30 days and 6 months of lien filing. Mechanic's liens cannot be extended in Nevada.

Preliminary Notice & Notice of Intent

Preliminary Notice: A Notice of Right to Lien to be served after first delivery of materials or labor and within 31 days of starting work for subcontractors and suppliers (NRS 108.245(1)). A prime contractor or other person who contracts directly with an owner or sells materials directly to an owner is not required to give notice pursuant to this section (NRS 108.245(5)). Notice of Intent to Lien: On residential projects, must be served 15 days before lien filing.

Who Can File a Mechanic's Lien

Contractors, subcontractors, laborers, suppliers, architects, and engineers are entitled to mechanic's lien rights in Nevada. Contractors that do not have the required state business and/or contractor licenses for the work they perform do not have lien rights.

Who Gets the Notice

Notice is given to the project owner and general contractor, and it is recommended to be sent to all parties up the payment chain from the claimant.

Nevada Public Works

In Nevada, a mechanic's lien on public works projects is not available. Subcontractors and suppliers have a claim against a general contractor's payment bond. Claimants who do not have a direct contract with the general contractor must give preliminary notice to the general contractor within 30 days of first furnishing labor or materials. Suit must be filed not less than 90 days and not more than 1 year from last furnishing labor or materials.
