Ohio Lien Deadlines

Preliminary Notice

21 days

Notice of Furnishing must be given within 21 days of starting work or within 21 days of the Notice of Commencement filing. Subcontractor may request a copy of the Notice of Commencement from the owner or general contractor. Information should match the details on the Notice of Commencement.

Mechanic's lien

60-75 days

Must be filed within 75 days of last work (reduced to 60 days for residential projects). Enforcement must be initiated within 6 years of lien filing. Mechanic's liens cannot be extended in Ohio.

Contractors, subcontractors, and suppliers are entitled to mechanic's lien rights in Ohio.

Who Gets the Notice

Notice is given to the project owner and general contractor. All the information on all notices and liens should be consistent with the information provided on the Notice of Commencement.

Information needed to file a mechanic's lien in Ohio includes: - All the information that is stated on the Notice of Commencement - Project owner's name - Description of the property - Amount owed - Dates of first and last furnishing - Claimant's information

Ohio Public Works

In Ohio, both a lien on public funds and a suit on a payment bond are available if they send a Notice of Furnishing to the Surety of Bond Company, owner, and general contractor. Subcontractors, sub-subcontractors, and suppliers are eligible for claims. For a lien on public funds, notice is required within 120 days of last work. Suit must be filed within 60 days of sending notice. For a suit on a payment bond, notice must be given within 90 days of the public authority accepting the project. Suit must be filed after 60 days from sending notice, but within 1 year of the public authority accepting the project.
